Virtual Data Protection Officer
An external Data Protection Officer gives your organisation independent privacy advice, oversight and a route for concerns to reach senior management.
Who decides whether employee monitoring can proceed?
HR proposes a new monitoring tool. The vDPO provides independent advice on necessity, proportionality and whether an impact assessment is needed.
Illustrative privacy decision
- Advice
- Identify the people affected, assess the proposed monitoring and record the vDPO’s advice for HR.
- Decision
- Management decides whether to change, postpone or proceed, and records its reasons.
- Escalation
- The vDPO can raise a material unresolved concern with the highest management level and monitor the agreed action.
Agree the appointment and its boundaries
Start with your processing activities and the legal regime that applies. We help you assess whether a DPO is required, or whether you need privacy advice without a formal appointment. Public authorities and certain large-scale monitoring or sensitive-data activities can trigger a requirement.
A Virtual Data Protection Officer (vDPO) can be engaged under a service contract. Agree access to information, resources, a direct reporting line to the highest management level, availability and how people can contact the DPO. Identify conflicts of interest before the appointment.
How the vDPO works with your organisation
Establish the priorities
Review the processing inventory, sensitive activities, current risks, outstanding requests and recent incidents. Set an oversight plan with owners, reporting dates and a route for raising urgent concerns.
Advise the people making changes
Advise teams on data protection impact assessments, new suppliers and changes to how information is used. Record the advice and management’s decision. The DPO monitors compliance, supports staff awareness and acts as a contact point for individuals and the ICO.
Escalate independently
Bring unresolved risks and overdue actions to senior management. Protect the independence of the DPO’s advice and avoid roles where the same person determines why or how personal data is processed.
What management receives
Agree a reporting rhythm suited to your risk and the contract. A management report can cover high-risk processing, impact assessments, incidents, rights requests, training and the actions awaiting a decision. Urgent issues use the agreed escalation route.
For a first discussion, bring the names of your privacy owners, your processing record if available, any current impact assessments and the decisions that need advice.
